Mr. Tope, the learned Advocate for respondent No.2 submits that the Board of Examination has taken decision on the basis of enquiry report submitted by the Committee to cancel performance of the petitioner and other students. Copy of the order is submitted by Mr. Tope. 2.

Mr. Kulkarni, learned Advocate for the petitioner submits that in view of that, in the present writ petition, grievance of the petitioner cannot be considered. It would be open for the petitioner to assail the decision of the Examination Board as is permissible in law.
