The present applicant submits that the present non applicant no. 9 has filed the writ petition seeking directions to issue Property Card after measurement of Plot No. 15/1. It is the case of the present applicant that the non applicant no. 9 is not the allottee and possessor of Plot No. 15/1, Survey No. 3 and 4 at Paithan and that the allotment letter is obtained by fraud.

We had issued notice on 15.03.2019 to the non

2 ca 2037.19 applicant no. 9. The Registry has informed that non applicant no. 9 is served, none appears for non applicant no. 9.

Considering the aforesaid averments made, the civil application is allowed in terms of prayer clause "B".
