Heard learned counsel for the applicant. The applicant is seeking permission to change the name of respondent No.1 as mentioned in prayer clause 'B'

. The bailiff report indicates that respondent No.1 refused to accept the notice since there was difference in the name of his father. According to him, his father' s name is Vilas and not Vijay as mentioned in the appeal. As such, for effective service upon respondent No.1 in the application is allowed in terms of prayer clauses 'B' and 'C'

. The correction be carried out forthwith and on such correction, issue notice to respondent No.1, returnable on 08.02.2023.
