The learned counsel for the parties have placed on record order passed in First Appeal 2460 of 2008 and other connected first appeals dated 21.04.2022, wherein the appeal filed by the acquiring body, so also, by the claimants are dismissed. He submits that the same would be applicable to the facts of the present case as the appeals are arising out of the same acquisition proceedings, section 4 notification is

2 965 also same, so also, the lands are similarly placed as of First Appeal No. 2460 of 2008 and other connected matters.

In view of the same, First Appeal No.942 of 2011 and First Appeal No.2737 of 2010 are dismissed accordingly. 3.

The amount deposited in this court is permitted to be withdrawn by the applicants / claimants in terms of the order passed by the reference court along with accrued interest. 4.

Civil Application No.8546 of 2024 is also accordingly disposed of.
