The petitioner is seeking an appropriate writ or order directing the respondent No.2 to consider the name of the petitioner for grant of additional two marks in the examination held on 25th November 2015. Learned counsel for the petitioner invited our attention to the question paper and pointed out that after question No.46, candidate was asked to find out superlative degree in respect of three questions after 47. It is submitted that the question No.50 was not included. Since it was not mentioned, the petitioner was unable to answer that question. It is submitted

{2} wp 11411.16.odt that if two marks are granted, the petitioner would be first in the waiting list. Petitioner had made representation on 20.12.2015 to respondent No.1.

In our view the request made by the petitioner cannot be granted. At the first place, perusal of the question paper would reveal that any person of average intelligence would realize that question No.46 was a part of earlier three questions and the candidate obviously was expected to find out the superlative degree in respect of question Nos.47 48, 49 and 50 and particularly 50.

The petitioner appears to have made a complaint, almost after one month, after he realized that it is just for few marks, he would be first in the waiting list. No other person has made the complaint regarding such questions. We are therefore not inclined to grant the relief claimed by the petitioner. Petition is dismissed.
