1] The amount deposited by the appellant / insurance company is directed to be transmitted to the Motor Accident Claims Tribunal at Dhule, which was taking up the Motor Accident Claim Petition No.79/2015, within a period of two weeks from today. Thereafter, the applicant in Civil Application No.973/2018 is permitted to withdraw 50% of the deposited amount by filing an

CA 973/18 in FAST 18751/17 - 2 - undertaking before the MACT that such withdrawal will abide by the final orders in this appeal. Copy of such undertaking be furnished to the learned counsel for the appellant / insurance company. Said copy should also be placed on the record of this appeal.

2] Balance 50% amount be invested in any Nationalized bank in a suitable fixed deposit.
