Upon instructions from his client, the learned counsel for the applicant wish to withdraw the present application. He submits that liberty be granted to him to file Criminal Revision before the Sessions Court with an application for condonation of delay.

Upon prayer made by the learned counsel for the applicant, the present Criminal Application is dismissed as withdrawn with liberty to move the Criminal Revision along with an application for condonation of delay. The learned Revisional Court should decide the said application on its own merit, in accordance with law.
