Heard rival submissions. The applicant is claiming permission to bring himself on record being the legal heir of original respondent No.3 -Drupatabai Vishwanath Wakode who was one of the claimants. She died on 29.03.2006 and therefore there is delay of 4861 days. However, considering the right to defend, the application stands allowed in terms of prayer clauses 'B' and 'C' . The amendment be carried out by the appellant -Insurance Company within the stipulated period.
