By this petition the Petitioner is seeking a direction to the Respondent / Authority to decide an application filed under Section 28A of the Land Acquisition Act, 1894 for re-determination of compensation amount.

The record shows that the application was filed as far back as on 24.12.1990 by the father of the Petitioner. The copy of the death certificate on record shows that he died on 27.11.1999. 3.

There is nothing to show that the Petitioner took any steps for being substituted in place of his father in the said application. There is

( 2 ) 922 wp 10127.25 nothing on record to show that the said application is still pending, although a statement is made on behalf of the Petitioner that the aforesaid application is pending before the concerned Authority. 4.

We are of the opinion that the Petitioner ought to take appropriate steps for being substituted in the place of his father in the said application.

At this stage, the learned counsel for the Petitioner seeks permission to withdraw the writ petition with liberty to pursue the matter before the appropriate Authority, before whom the application under Section 28A of the aforesaid Act was filed. The Writ Petition is disposed of as withdrawn with liberty as aforesaid.
