Heard the learned advocate for the petitioner as also the learned AGP.

The petitioner which has been registered as a company pursuant to the modalities prescribed for extending the benefits of Nanaji Deshmukh Krushi Sanjeevani Prakalp, is challenging the order dated 31.01.2024 holding it to be not entitled to derive any benefit under the scheme.

Incidentally, by the selfsame impugned communication/ decision a similar proposal, in addition to the petitioner's, of one Shreya Patil Agro Producer Company Ltd. was also rejected for the same reasons and grounds which are germane to that other company. It had 1/2
946.WP.12573.24.odt challenged that order by preferring WP No.2144/2024. By the order dated 26.08.2024 division bench of this Court, for the reasons recorded therein, had allowed the writ petition, quashed and set aside the decision and directed the authorities to initiate steps for granting funds to that company following the due procedure as is applicable and the guidelines as modified by the Corrigendum dated 23.08.2022. 4.
Both the sides are unanimous that even to the extent of the petitioner company, the reasons assigned by the coordinate division bench would sustain and would apply on all fours. 5.
In the light of such consensus ad idem, the writ petition is allowed for the same reasons and with the same directions as have been recorded/directed in Writ Petition No.2144/2024. (PRAFULLA S. KHUBALKAR, J.) (MANGESH S. PATIL, J.) habeeb/ 2/2
