Heard Mr. D.K.Kulkarni, the learned counsel for the petitioner, who is the appellant/original accused before the appellate Court and convicted by the learned trial Court for the offence punishable u/s 138 of the Negotiable Instruments Act.

After hearing the learned counsel for the petitioner, it is clear that the learned Additional Sessions Judge, Bhusawal has not committed any error in rejecting the application filed by the present petitioner for additional evidence. The learned Additional Sessions Judge has specifically observed in the impugned order that the Appeal was ready for final hearing and the present petitioner was

2 Cr. W.P. 1539.2014 avoiding hearing and for that the learned appellate Court was required to issue warrant against the present petitioner and after that the present application was moved. It clearly shows that the petitioner is indulging himself in dilatory tactics. No case is made out for interference.

In that view of the matter, the present Writ Petition is rejected.
