Heard the learned counsel for the petitioner for some time. 2.

Perused the status report submitted by the Additional Sessions Judge, Aurangabad. It appears that the prosecution has examined in all 20 witnesses so far. However, cross-examination of P.W. 19 is under progress at present as the trial court has permitted to cross-examine P.W.19 by setting aside the earlier order of no-cross. The learned Judge of the trial court has specifcally stated in the report that the trial could not be completed expeditiously due to non-cooperation of the defence and secondly due to lapse of the time in challenging two orders passed by the court before this court by the defence.

Thus, considering the entire aspect of the case, in stead of wasting our time to issue notice to the respondent/accused, we direct the trial court to dispose of the case as expeditiously as possible by day today hearing, if convenient and dispose of the same preferably within a period of three months from the date of this order.

We expect from the defence to extend full cooperation to the trial court in disposing of the case in the time bound manner as directed.

Writ petition is accordingly disposed of.
