Learned Advocate Mr. M. P. Tripathi for the applicants submits that on instructions he is making a statement that the applicants do not have passport. As regards the condition for attendance is concerned, learned APP says that the open inquiry is going on and the applicants should remain present as and when called.

Under such circumstances, the condition No.III imposed by this Court by order dated 20-09-2021 to Bail Application No.965 of 2021 stands modified for attendance to the police station as follows :- "III....The applicants shall remain present before the Investigating Officer as and when called, for which the Investigating Officer to give prior notice of 48 hours to the applicants. After the notice would be received by the applicants, they should remain present and shall not
CA 3312-2021 claim excuse on any ground."

The other conditions as regards passport, in view of the statement, will not be applicable.

Further, the learned Advocate for the applicants prays for allowing applicant No.1 to visit his house in Mumbai where his children are staying. In view of the restrictions imposed in condition No.II, applicant No.1 is unable to visit, and therefore, he seeks modification or relaxation to that extent.

The prayer for permanent relaxation stands rejected, but the applicant No.1 is permitted to visit to his house at Mumbai between 01.02.2022 and he should again report to his Headquarters on 14-022021, if he has leave at his balance and he should get his leave sanctioned from the competent authority in advance. Application stands disposed of.
