Heard the learned A.P.P. appearing for the applicant/State and the learned counsel appearing for the respective respondents. Perused the notes of evidence and the findings recorded by the trial Court.

Upon examining the findings recorded by the trial court, in the light of evidence brought on record, it appears

6711.13appln that electric connection/supply of the respondents was without recourse to the proper procedure and without approval of the concerned Department.

In that view of the matter, the case is established for allowing the application seeking leave to appeal.

Accordingly, the application is allowed and the same stands disposed of.

Appeal is admitted. On admission, the learned counsel waives service on behalf of respective respondents.

Action under Section 390 of Code of Criminal Procedure to follow before the Additional Sessions Court at Sangamner.
