The petitioners are disqualified on the ground that they have not submitted the caste validity certificates within six months as required u/s 10(1-A) of the Maharashtra Village Panchayats Act, 1958.

The learned Advocate for the petitioners submits that the petitioners have been issued caste validity certificates.

However, it was after lapse of six months.

The Supreme Court in SLP (C) No.29874-29875/2016 - Shankar s/o Raghunath Devre (Patil) Vs. State of

13567.17wp Maharashtra and ors., has stayed the judgment of this court. The Full Bench of this Court has held the said condition to be mandatory. As the said judgment of Full Bench of this Court is stayed, the impugned order is quashed and set aside.

The respondent - authority is at liberty to take further decision in case the judgment of Full Bench of this Court is upheld by the Supreme Court. The writ petition stands disposed of accordingly.

No costs.
