Heard the learned Counsel for the Applicants and the learned APP.

The learned Counsel Mr. Nagargoje for the Applicants on instructions, seeks permission to withdraw the application to the extent of Applicant No.2/Rushikesh Andhale, as this Court was not inclined to grant anticipatory bail to Applicant No.2/Rushikesh Andhale.

Permission is granted. The application stands disposed of as withdrawn to the extent of Applicant No.2/Rushikesh Andhale. 4.
Insofar the Applicant No.1/Govind Andhale is concerned, after issuance of notice, the learned APP has made available the
2 937.ABA-1891-2025.doc investigation papers for perusal of this Court. The investigation papers would show that the injury attributed to Applicant No.2/Rushikesh Andhale, appears to be grievous in nature. However the injury attributed to the alleged assault by the Applicant No.1/Govind Andhale, appears to be simple in nature. It is submitted that there was already an FIR filed for the same incident, by the Applicant himself prior in point of time and therefore this is a counter FIR to the said FIR. The FIR filed by the Applicant No.2/Rushikesh is dated 31.08.2025 registered for the incident dated 30.08.2025 being FIR No.382/2025. Whereas the present FIR is dated 04.09.2025 being FIR No.388/2025 for the same incident dated 30.08.2025.

Looking to the nature of injury as reflected from the injury certificate and attributed to the Applicant No.1/Govind Andhale, I am inclined to protect the Applicant No.1/Govind Andhale. Hence the following order :
ORDER
(i) In the event of arrest of the Applicant No.1 - Govind Manik Andhale in connection with Crime No.388/2025 registered with Parali Rural Police Station, Parali Vaijanath, District Beed, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties in the like amount, on the following conditions :
(a) The Applicant No.1/Govind Andhale is directed to attend the
3 937.ABA-1891-2025.doc concerned police station and report to the Investigating Officer as and when called, until the filing of the charge-sheet. (b) The Applicant No.1/Govind Andhale shall not tamper with the prosecution evidence and shall not influence the witnesses. (c) The Applicant No.1/Govind Andhale shall submit his Aadhaar Card and PAN Card to the Investigating Officer, along with detailed addresses and phone numbers of himself and two close relatives. (d) The Applicant No.1/Govind Andhale shall attend the trial regularly except in emergency, he can seek exemption from the trial Court.
(ii) The application is allowed in the above terms and stands disposed of.
