THE STATE OF MAHARASHTRA AND ORS.
...
Advocate for petitioner : Mr. ِN.P. Bangar APP for Respondent/State:Mr.D.R. Kale Advocate for respondent nos.3&4:Mr.R.V. Gore ...
CORAM: S.S.SHINDE & K.K.SONAWANE, JJ.
Dated: December 19, 2016 ...
Heard the learned counsel appearing for the petitioner, the learned A.P.P.
appearing for the Respondent/State and the learned counsel appearing for respondent nos.3 and 4.
2.
We have carefully perused the reply filed by respondent no.1. It appears that since the year 2014, the concerned Officers have made efforts for redressal of the grievance of the petitioner. Even earlier two affidavits have been filed by the concerned Police Officer. It appears
that inquiry of relatives and in-laws is done and also the record from the State CID, Pune is checked. The photographs of the missing woman is published in local news papers, local news channels and Doordarshan.
3.
When this Petition was taken up for hearing on 28th November, 2016 at the request of the learned counsel appearing for the petitioner hearing of this Petition was deferred till 9th December, 2016 so as to enable the petitioner to give input/clues/suggestions for further investigation. Again on 9th December, 2016, the hearing of this Petition was deferred granting further opportunity to the petitioner to give input/clues/suggestions for further investigation. The learned counsel appearing for the petitioner, on instructions, submits that there are no further suggestions. However, he submits that the concerned Investigating Officer to continue his investigation/search in future and as and when the petitioner gets any new information or suggestion or input, he will approach the Investigating Officer. In case, the petitioner approaches the Investigating Officer in
future for giving clues/suggestions, as the case may be, the concerned Investigating Officer may take into consideration his clues/suggestions, if any in future.
4.
We are satisfied with the efforts taken by the Respondent Officers. On couple of occasions we directed the Superintendent of Police to look into the matter and monitor the further investigation/search by the concerned Police Officer. Pursuant to the said directions, the Superintendent of Police has also taken sincere efforts and filed the affidavits. Be that as it may, as assured the Superintendent of Police in his affidavit filed before this Court has stated that the search/investigation will continue in future. We dispose of this Writ Petition, however, we make it clear that in case, the petitioner in future gives some suggestions or any new clue or input, the concerned Officer may cause investigation and may search on the basis of such suggestions/clues if any.
