Heard learned counsel for the applicant and learned APP for the State.

The prosecution has relied upon the CCTV footage in which the co-accused and the deceased were seen. The co-accused has produced mobile handset of the deceased. The deceased had threatened the co-accused to disclose about the unnatural intercourse with him. Hence the incident happened.

Nothing has been recovered from the applicant. Considering the papers placed before this Court, the Court is of the view that the applicant has a prima facie case for bail. Hence the order:

i.

The bail application is allowed.

ii.

The applicant Feroz Younus Shaikh be released on bail on executing P. R. and S.B. of Rs.50,000/- with one solvent surety of the like amount in connection with Crime No. 0151/2022 registered with Jinsi Police Station, Tq. & Dist. Aurangabad for the offences punishable under sections 302, 377, 362, 364, 364(A) r/w 34 of the Indian Penal Code on the condition that he shall not tamper with the prosecution evidence.
