Heard the learned counsel for the applicant and the learned A.P.P for the respondent State.

The prosecution rest upon the circumstantial evidence. The applicant has been arraigned as an accused since he had quarreled with the deceased one and a half months before the incident. Nothing has been recovered from the applicant. The rope allegedly used to strangulate the deceased has been recovered from the father of the applicant. There is no incriminating evidence against the applicant to link him with the alleged incident. There are no antecedents to his discredit. The audio clip having exchange of hot words has been recovered but that does not appear to have link with the present crime
919- B. A. No. 2039-2022.odt at the hands of the applicant. In the fats and circumstances of the case, the application deserves to be allowed. Hence, the following order :- i) The application is allowed.
ii) Applicant Vishal Suresh Londhe be released on bail, on furnishing P.B. and S. B. of Rs. 50,000/- with one solvent surety of like amount in C.R. No. 237/2022 registered with Police Station New Mondha Police Station, Parbhani for the offence punishable under Sections 302 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the trial on each and every effective date of hearing.
