The learned counsel appearing for Respondent Nos. 3 and 4 has tendered across bar copy of the judgment and order in Writ Petition No. 6110 of 1196 (Shrinivas Govind Samant and others V/s The State of Maharashtra & others) decided on 29th March, 2007 and also copy of the order passed by this Court in Writ Petition No. 3239/2012 and on instructions submits that, the issue raised in the present Petition, is squarely answered/covered by the aformentioned judgment and order.

The relief claimed being identical and on same facts, this Writ Petition is allowed. Rule is made absolute in terms of prayer clause `B'.
