The learned counsel for the applicant seeks correction in the title clause of the memo of Writ Petition No. 4365 of 2019. The writ petition has been disposed of. The respondent No. 2 in the writ petition is Charity Commissioner, Aurangabad Division, Aurangabad. An order passed by the Deputy Charity Commissioner was under consideration before this Court. At the relevant time Appeal No. 8 of 1978 was being considered by the Deputy Charity Commissioner, appellate power Maharashtra State, Mumbai.

While disposing of the petition by order dated 03rd July,

2 ca 13751.23 2023 directions were issued to the respondent No. 2 to decide the appeal on merits. The learned counsel informs that Appeal No. 08 of 1978 has been transferred to Joint Charity Commissioner, Latur Division, Latur. The authority is seized of the matter and the direction needs to be issued to the said authority. 3.

The learned counsel for the respondent No. 1 does not have objection.

The civil application is allowed in terms of prayer clause 'B'. Necessary amendment be carried out forthwith. The civil application is disposed of.

In view of this, the petitioner shall deposit an amount of Rs. 10,000/- (Rs. Ten thousands only) as directed by order dated 03rd July, 2023 with newly substituted authority. [ SHAILESH P. BRAHME, J. ] bsb/Dec. 23
