The application had been moved for quashing and setting aside the impugned order since the parties have settled their dispute amicably. The parties are before the Court and agreed with the settlement terms. They have no dispute.

The offence under Section 138 of Negotiable Instruments Act is compoundable with the consent of parties. The settlement terms have been accepted. In view of the settlement terms, the following order is passed :

ORDER

I) The impugned judgment and order of the learned J.M.F.C, Court No.3, Shirpur, District Dhule passed in S.T.C. No.114 of 2016 dated 09.04.2018 and the order of the learned Sessions Judge, Dhule

67-appln-4321-2022.odt (2) passed in Criminal Appeal No.51 of 2018 dated 16.11.2022 are hereby quashed and set aside.

II) The applicant/accused stands acquitted.

III) In view of the above terms, Criminal Application No.4123 of 2022 stands disposed of.
