The present application has been filed by the applicant Nos. 1 and 2, who are original respondents nos. 1-A, 1-B in First Appeal. They are legal heirs of original claimant Manik Hanmanta Sagar, who died and his legal heirs present applicant nos.1 and 2 as well non-applicants 3-A-1 to 3-A-4 are brought on record.

Since the land of the predecessor of the present applicants / original respondent nos.1-A and 1-B have been acquired and the applicants having equal share with other legal heirs of original Manik Hanmanta Sagar, therefore, the applicants are permitted to withdraw the compensation amount to the extent of 50% of their share on furnishing undertaking and 25% on furnishing solvent surety out of the

923-ca-1251-24 amount deposited by the acquiring body to the satisfaction of the learned Registrar (Judicial) of this Court.

The learned Registrar (Judicial) to disburse the amount accordingly.
