After hearing learned counsel for the petitioners for some time and when this Court is not inclined to cause interference in the impugned order, learned counsel for the petitioners, on instructions, seeks withdrawal of the petition. While withdrawing petition, he submits that the observations made by the learned Appellate Court in Paragraph 7 of the impugned order about the application being mischievous be struck off. It is his submission that if these observations are allowed to be remained on record, prejudice will cause to the petitioner during course of arguments as well as would have influence on decision of the appeal.

This Court finds substance in the said contention. Hence, this petition is dismissed as withdrawn. However, observations made by the learned Appellate Court with regard to the application being mischievous stands struck off.
