The submissions made show that in a case filed by Respondent under section 138 of Negotiable Instruments Act the evidence of the complainant is not yet over. The present applicant, accused wants that the cheque should be sent to handwriting expert for comparison of signature etc. appearing on the cheque. The application does not show that any specific defence is taken by the applicant, accused. Unless and until the evidence of the complainant is over and some defence is taken by the application, accused, there is no question of sending the
