The petitioners claim to be the founder trustees of the respondent trust/ Purna Kaveri Shikshan Sanstha, Sillod. They are aggrieved by the order dated 16.09.2019 by which, the learned Assistant Charity Commissioner has rejected the application exhibit 33 in Change Report No.212/2015.

The petitioners had sought production of the original records and proceedings of Change Report No.1831/2008, which are in the custody of the Kranti Chowk Police Station in some criminal case. Though the present pending proceeding pertains to the elections held for the years 2013 to 2018, the petitioners have called for the production of documents pertaining to the election held in 2008 to 2013, which was the subject

*2* 959wp14128o19 matter of Change Report No.1831/2008. It is contended that the change report proceedings of 2008 indicate that the petitioners have resigned their membership. The said Change Report No.1831/2008 was allowed and the change report was accepted on 02.06.2009. It was thus, conclusively proved that the petitioners had resigned from the Trust and this aspect was established in the said proceeding. In view of the above, I find that the leave granted by the authority below permitting the petitioners to produce the certified copies of the said record in Change Report No.212/2015, cannot be faulted. This Writ Petition, being devoid of merit, is, therefore, dismissed. kps (RAVINDRA V. GHUGE, J.)
