The applicant is seeking pre-arrest bail in Crime No.II-46/2015, registered at Kopargaon City Police Station, District Ahmednagar, for the offences punishable under Sections 323, 504, 506 of the Indian Penal Code and under Section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 3.

Learned Counsel for the applicant submits that the charge-sheet is already filed, as such the custodial interrogation is not necessary.

While opposing the bail, learned A.P.P. would urge that in view of bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, application is not tenable and liable to be rejected.

Having regard to the fact that the investigation in the matter is already concluded and the charge-sheet is filed, it appears that the custodial interrogation of the applicant is not necessary. 6.

This Court has already protected the applicant vide order dated 3rd December 2015. In view thereof, the ad interim protection granted to the applicant is confirmed.
