Considering the nature of the challenge in the present appeal, the applicant is allowed to withdraw 50% of the amount deposited together with proportionate interest upto date, upon his executing an undertaking before this court that in case of any order adverse to his interest is passed, he would refund the amount within a period of three months from the date of the said order.

Civil application stands disposed of.
