BENCH AT AURANGABAD WRIT PETITION NO.11581 OF 2015 Vrushali D/o Rajendra Patil Petitioner
Versus
The State of Maharashtra and others Respondents Mr.H.H. Padalkar advocate for the petitioner Mr.M.B. Bharaswadkar, AGP for Respondent State _______________ CORAM : R.M. BORDE & A. I. S. CHEEMA, JJ.
Dated : 1st DECEMBER, 2015.
PER COURT :- The petitioner has been prohibited from appearing for the B.D.S. Final examination, which has already commenced since 28.11.2015. The petitioner contends that, the communication issued by the University on 5.11.2015 was not brought to her knowledge by the College. Petitioner further contends that, she is in fact regular in attendance and her attendance is more than 80% which is reflected from Annexure-B.
As has been recorded above, the programme of examination has already commenced since 28.11.2015. The University is not before this Court. In these circumstances, it would be difficult to direct the University to make preparations so as to enable petitioner to appear for examination from tomorrow. Another
{2} wp 11581.15.odt factor, which is required to be taken into account is that, the petitioner has already lost opportunity to attend examination for two subjects. In the midst of the examination process, no interference need be caused.
Without touching the merits of the contentions raised by the petitioner, the writ petition stands disposed-of. ( A. I. S. CHEEMA, J) (R.M.BORDE, J) vbd
