The Applicant Sugar Factory prays for extension of time by two weeks to implement the order of this Court dated 28.09.2017. I have considered the submissions of the learned Advocates. Shri Patil has strenuously opposed this application and contends that the same be rejected. In the alternative, he submits that if this Court is inclined to entertain the application, heavy costs may be imposed and the said amount be donated to the Advocates Association of Bombay High Court, Bench at Aurangabad.

Considering the above and for the reasons set out in the Civil

Since this Court had granted two weeks to carryout amendment on 28.09.2017 and as the amendment is not carried out for the last about more than three months, the Applicant is permitted to carryout the amendment on or before 25.01.2018 on the condition that the Applicant shall deposit costs of Rs.5000/- (Rupees Five Thousand) with the Advocates Association of Bombay High Court, Bench at Aurangabad on or before 25.01.2018, failing which, this order shall stand recalled, the Civil Application shall stand rejected thereby, depriving the Applicant of the liberty to carryout the amendment. kps (RAVINDRA V.
