Heard learned Counsel for the applicant. Though we are not convinced by the reasons stated in the application, for the mistake of the advocate, the litigant should not suffer and the learned Counsel for the petitioner has shown willingness to deposit Rs.1000/- (Rupees One Thousand) towards costs with High Court Bar Association Library, Aurangabad.

In the interest of justice, the application is allowed in terms of prayer clause(B), subject to depositing Rs.1000/- (Rupees One Thousand) with the High Court Bar Association Library, Aurangabad and on production of receipt of costs, Contempt Petition St.No.38601 of 2016 shall stand restored to its original file.
