JUNE 09, 2025 ORDER :- The petitioner has challenged the order dated 09.07.2007, passed by respondent no.3, invalidating his claim as "Naikda", scheduled tribe.

Learned counsel for the petitioner, on instructions from the petitioner, who is present in the court, submits that the petitioner has secured some more documents, which were not available at that point of time. He submits that the said documents, which the petitioner secured recently, are helpful to establish his claim as "Naikda", scheduled tribe. He submits that respondent no.3 - Committee may be directed to consider the said documents and reconsider his tribe claim, by setting aside the impugned order.

Learned AGP for respondent nos.1 to 4 submits that in the event the petitioner approaches respondent no.3 - Committee with the documents, the Committee will consider the same and decide the tribe claim of the petitioner afresh, in accordance with law.

In view of the above statement, the impugned order dated 09.07.2007, passed by respondent no.3 - Committee is quashed and set aside. The petitioner shall approach respondent no.3 - Committee on 23.06.2025, with whatever documents he has in his possession. On receipt of the documents by respondent no.3, it shall follow the required procedure for deciding the tribe claim of the petitioner by giving him opportunity of hearing. Respondent no.3 - Committee shall decide the tribe claim of the petitioner afresh within a period of six months from the date of submission of the documents by the petitioner.
