Heard the learned counsel appearing for the applicant and the learned counsel appearing for the respondents i.e. appellant insurance company. Having considered the submissions so made, I am inclined to pass the following order:

ORDER

i) The applicants are permitted to withdraw an amount of Rupees Eight Lakhs from the amount deposited by the insurance company in this court on submitting an undertaking that if any adverse order is passed they will re-deposit the amount so withdrawn by them within four months of passing such order.

ii) Balance amount be invested in any nationalized bank in F.D.R. initially for a period of two years and if required, for a further period till the disposal of the appeal.

924 ca 15485.16.odt iii) Civil application stands disposed of.

iv) Before disbursement of the amount the registry shall ensure that deficit court fees is paid by the present applicants i.e. original claimants.
