Learned A.G.P. submits that the petitioner has also filed an appeal before the Hon'ble Minister in respect of writ subject and has obtained orders of stay in the said proceedings. 3.

Mr.Devakate, learned counsel submits that at the time of filing the Petition, he was not instructed about the appeal being filed and upon instructions states that on the same day the appeal and Writ Petition are filed.

Be that as it may, as appeal is already filed before the Hon'ble Minister, the petitioner is at liberty to prosecute the said

remedy before the Hon'ble Minister.

All contentions of respective parties are kept open. 6.

The Writ Petition is disposed of. No costs.
