Mr.Vaidya, the learned counsel for the respondent Nos. 2 to 6 - Municipal Corporation tenders copies of photographs of the concerned park to appraise this Court that the cattle shed constructed over a children park has been demolished and no objection certificate had been given to the Public Works Department for beautification of the said park. 2.

Mr.Jadhav, the learned counsel for the petitioner draws attention of this Court to the letter dated 13th December

- 2 - 2022 vide Exhibit 'B' and submits that the said allocated fund of Rs.30,00,000/- should now be utilized by the Public Works Department for development and beautification of the play ground / children park.

In view of the aforesaid submissions made at the bar, this public interest litigation is disposed of with a direction to the Municipal Commissioner through the Chief Engineer at Aurangabad of the Public Works Department to co-ordinate amongst them and ensure proper utilization of the funds allocated for development and beautification of the play ground / children park, if available. In the event, the said fund is lapsed, necessary arrangements may be made in this financial year or in the next financial year for allocation of proper fund for development of the play grounds / children parks. We may further indicate that while preparing a plan for development of the play grounds / children parks, the subject play ground/children park in this public interest litigation may also be included in that plan.
