The applicant has filed the present bail application seeking regular bail in connection with FIR bearing Crime No. 478 of 2025, lodged on 25.08.2025 with Jintur Police Station, District - Parbhani, for the offences punishable under Sections 54, 56, 109, 189(2), 189(3), 189(4), 190, 191(2), 191(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the prosecution case that on 24.08.2025 at about 06:00 p.m., a dispute had taken place between the husband of the complainant's paternal aunt and accused Bashir, which was later resolved. However, at about 09:00 p.m., upon hearing commotion, the complainant's father Ratan and brother Mobin came out of the house and saw that Anwar, Ilai and Malika were being assaulted by 1/4
accused Bashir, Rajek, Isak and Ashfaq with sticks and an iron rod. The complainant Mohasin was also assaulted on both legs with a rod, causing serious injuries. Ratan and Mobin were similarly assaulted with sticks. It is alleged that accused Rajek struck Ilai on the head with an iron rod with an intention to cause his death. Ilai is presently admitted in Parvati Ambhore Hospital, Parbhani, while other injured persons were admitted in the Government Hospital, Parbhani. 3.
Learned counsel for the applicant submits that the allegations against the present applicant are almost similar to those against coaccused Shaikh Basheer Shaikh Karim, who has been granted protection by this Court vide order dated 10.11.2025 in ABA No. 1926 of 2025. Though the FIR contains direct allegations against the applicant, learned counsel submits that there is a counter-FIR bearing Crime No. 480 of 2025 dated 25.08.2025 lodged by the applicant, wherein it is alleged that the applicant himself was assaulted by Mohsin (the complainant in the present FIR), Ratan, Ilai and Anwar. In the said counter-FIR, although similar allegations of assault by iron rod are made against Mohsin, both Mohsin and co-accused Ilai have already been granted anticipatory bail by the Sessions Court vide order dated 29.10.2025. The order is taken on record and marked 'X' for identification.

The applicant has been in custody since 27.08.2025. Further detention of the applicant would not serve any fruitful purpose. The investigation is almost complete. Hence, I am inclined to grant bail to the applicant, subject to the following conditions :-
O R D E R
I.
The application is allowed.
II. Applicant - Shaikh Rajek Shaikh Maksud Qureshi, be released on regular bail on furnishing P.R. bond of Rs. 25,000/- (Twenty Five Thousand Only) with one or two local solvent sureties in the like amount, in connection with FIR bearing Crime No. 478 of 2025, lodged on 25.08.2025 with Jintur Police Station, District - Parbhani, for the offences punishable under Sections 54, 56, 109, 189(2), 189(3), 189(4), 190, 191(2), 191(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :- (a) The applicant is directed to attend the concerned police station and report to the Investigating Officer as and when called, till framing of charge.
(b) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner. A single incident of such conduct 3/4
would entitle the prosecution to seek cancellation of the bail granted to the present applicants.
(c) The applicant shall submit his Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and two of the near relatives. 5.
