Mr.Bondar, learned counsel for the petitioners states that the petitioners had applied from Project Affected Persons category for the post of staff nurse. The posts are still lying vacant but the petitioners are not appointed only because the petitioners had filed Contempt Petitions against the Respondents, the petitioners were denied appointment. According to the learned counsel, there were about 76 posts of PAP category vacant, however, all these poses are not filled in.

According to the learned A.G.P. the petitioners were lower

in the order of merit, as such could not be appointed. The petitioner No.1 was at serial No.4902 in PAP open category and petitioner No.2 was at serial No.8795 in PAP OBC category. The selected candidates were more meritorious. Subsequent selection process has also been undertaken in the year 2014.

We have considered the submissions. There is nothing on record to conclude that the selection process in the year 2013 was not in consonance with law nor it was pointed out that the candidates possessing less merit than the petitioners were selected pursuant to the said selection process. The petitioners have also participated in the subsequent selection process. 5.

Considering above, the claim of the petitioners can not be considered. The Writ Petition as such is disposed of. No costs. (K.L.WADANE,J.) (S.V.GANGAPURWALA,J.) Dt.27.09.2016.
