Learned Counsel for the petitioners submits that, the petitioners, have retired as Head Master / Assistant Teacher from Zilla Parishad Services within the period from 1.1.2006 to 27.2.2009. The learned Counsel for the petitioners submits that the Division bench of this Court in case of Smt. Savitribai Narsayya Guddapa vs The State of Maharashtra and others (Writ Petition No.8985 of 2011 with connected petitions) vide judgment dated 9th May, 2014 has held that, even those employees who have retired in between 01.01.2006 to 27.02.2009 will also have benefit of the Government Resolution dated 30th October, 2009 for payment of revised pension under the Maharashtra Civil Services (Pension) Rules.

11683.15wp The respondents / State will be at liberty to verify the factual assertions made in the petition from the record maintained by the respondents/State.

In the light of that, the writ petition is disposed of. The respondents / State shall consider the cases of the petitioners for payment of revised pension as per the Government Resolution dated 30th October, 2009. The petitioners shall submit representations to that effect with the respondents/State and the respondents/State shall consider the said representations within a period of three months of its receipt and if found eligible as per the judgment of this Court, shall pay the same expeditiously. No costs.
