ORDER :

The application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation. 2.

The crime is registered on the basis of dying declaration of Smt. Vaishali. She was the wife of present applicant. The incident took place on 11.6.2014 after 2.30 p.m. She has disclosed that applicant had suspicion about her character and on that count, she picked up quarrel with her and then to finish her, he poured kerosene on her person and set her on fire. She has disclosed that after setting her on fire, she ran away. It is her case that neighbours came to extinguish the fire. The police papers include the statement of father of applicant to

Cri. Appln. No. 7007/14 the effect that the applicant had returned to home at the relevant time and he noticed that after that, the deceased was on fire. There are statements of neighbours like Narmadabai showing that when she reached the place after hearing shouting of the deceased, the deceased disclosed immediately to her that the applicant had set her on fire and after that, he ran away. She died due to burn injuries.

There is sufficient material on record to show the strong prima facie case of murder against the applicant. The learned counsel for the applicant submitted that chargesheet is filed and so, it is not desirable to keep him behind bars as he has been behind bars for more than six months now. In view of the aforesaid nature and material and the possibility of tampering with the prosecution witnesses at the hands of present applicant, this Court holds that it is not a fit case to grant bail. 4.
