1. Learned counsel for applicants submits that no notice was issued by the court in the main matter. There is delay in preferring the present application for restoration of second appeal. The delay so caused is not intentional or deliberate.

Civil application, for the reasons contained therein, is allowed in terms of prayer clauses "B", "C" and "D" subject to payment of costs of Rs. 500/- to be paid to Library, Advocates' Association, High Court, Bench at Aurangabad within a period of four weeks from today.
