The Appeal is ready for final hearing. Learned Counsel for both the parties are heard. Learned Counsel have no objection if the appeal is disposed of subject to condition that the amount, which is permitted to be withdrawn by the applicant, will be adjusted in the final Award when the main petition for compensation is disposed of.

Accordingly, First Appeal No.3 of 2011 is disposed of in the above-said terms.

Record and Proceeding be sent immediately to the Tribunal.

The Tribunal shall dispose of the main petition under Section 166 of the Motor Vehicles Act within a period of six months from the date of receipt of the Record and Proceeding. 5.

No costs.

In view of the above order, Civil Application No.61 of 2001 is also disposed of.
