Notice is given to Mr. Bade, learned Counsel for Respondent No.5 - society and he is present. Mr. Kadam, learned Counsel for applicant - District Co-operative Election Officer, Ahmednagar submitted that on the date which was fixed for polling, the polling did not take place due to some incidents and proper steps in that regard are already taken by the department. He submitted that the District Co-operative Election Officer will be now preparing the corrected voters list as per the directions given by this Court and new Returning Officer will be appointed. 1 / 2

Learned Counsel submitted that in view of this circumstance, permission is necessary to the District Co-operative Election Officer to implement the order already made by this Court on 21st October, 2016.
