Learned advocate for the applicant refers to objection in respect of respondent No.6 earlier being about incorrect address. Whereas it transpires that his name has not been properly incorporated in the array of respondents as far as memorandum of appeal is concerned. However, it has been correctly shown in memorandum of civil application for stay. He, thus, submits that the error is not deliberate nor it can be said to be apparent one for the reason, it was change in middle name and the omission did not come to notice due to inadvertence.

Having regard to aforesaid, I deem it appropriate to grant application in terms of prayer clauses "B", "C" and "D" and is disposed of. Memorandum of appeal be accordingly corrected. [SUNIL P. DESHMUKH, J.] drp/ca3023-16
