The learned APP pointed out that 4 witnesses in the matter are already examined. He also points out the order of the Hon'ble Supreme Court in the case of X Vs. State of Rajassthan & Anr., dated 27.11.2024 in Special Leave Petition (Criminal) No.13378 of 2024, more particularly, para 14 and contends that once the trial has commenced this court in the serious cases of rape, murder etc. would not ordinarily entertain the bail application.

Considering the submission of the learned APP, the learned counsel for the applicant seeks leave to withdraw the present application

2 930 with liberty to file appropriate bail application after the period of nine

(09) months if the trial does not proceed further. 4.

The application is dismissed as withdrawn with liberty as above.
