Heard learned counsel for respective parties.

Validation proceedings in respect of the tribe claim of the petitioner are pending since October 2013. The Employer has issued show cause notice to submit the validity within one

Considering the fact that validation proceedings are still pending, we pass the following order :

a) The Committee shall decide the validation proceedings expeditiously, preferably within eight (8) months. The petitioner shall cooperate in expeditious disposal of the proceedings. The petitioner shall appear before the Committee on 5.2.2018.

b) Till the validation proceedings are decided, the employer shall not take any coercive action against the petitioner only on the ground that validation proceedings are pending. The impugned show cause notice is quashed and set aside. The employer may take further course of action depending upon the judgment that would be delivered by the Committee in validation proceedings.
