This application is filed by the appellant for condonation of delay for filing Criminal Appeal. Initially, there was a confusion as regards filing of criminal appeal or criminal revision. Inadvertently appellant filed criminal revision, however, as per the provisions of 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the appeal was required to be filed. Accordingly, appellant thereafter filed this application for condonation of delay alongwith criminal appeal.

Learned Advocate Mr Karande for the applicant/appellant submits that the appeal is filed within limitation and the application for
4128.25appln (2) condonation of delay was filed under impression that appeal is filed belatedly. As per the provisions of Section 14(A)(3), the appeal is required to be filed within a period of 90 days. He further submits that since he was pursuing the matter by filing the revision application, the delay is caused on the part of Advocate for which the litigant should not be suffered.

In view of the above, this application is allowed. Delay in filing appeal is condoned. Criminal Appeal be registered. 4.
After registration of appeal, issue notice to the respondents, returnable on 05/01/2026. Learned APP waives service of notice on behalf of Respondent No.1.
