DATE : JANUARY 06, 2023 ORDER :- This is an application under Section 482 of the Code of Criminal Procedure for quashing FIR No.0746 of 2022 registered with Tofkhana Police Station, Dist.Ahmednagar, for the offence punishable under Section 420 of Indian Penal Code.

Heard learned counsel for the applicants, learned APP for respondent no.1 and learned counsel for respondent no.2. 3.

The aforesaid crime was registered pursuant to the FIR lodged by respondent no.2, alleging that the applicant and the coaccused had induced him to enter into a sale transaction in respect of

11-Cr. Appln No.4144 of 2022 the land gut no.64, Sayyadpur, Tq. Gangapur, Dist. Aurangabad. The respondent no.2 paid the sale consideration of Rs.11 Lakhs to the accused - Shaikh Akhtar. The accusation against the present applicant/accused no.2 in the crime is that he had introduced the seller to respondent no.2.

Learned counsel for respondent no.2, on instructions, states that the matter has been amicably settled between respondent no.2 and the applicant herein. The consent terms are placed on record. The respondent no.2 has filed his affidavit, wherein he has incorporated the consent terms. 5.

The dispute is of personal nature. Considering that the parties have settled the matter amicably, the application is allowed. FIR No.0746 of 2022 registered with Tofkhana Police Station, Dist.Ahmednagar, for the offences punishable under Section 420 of Indian Penal Code, qua the applicant, stands quashed, subject to costs of Rs.5,000/- (Rupees Five Thousand) to be deposited by the applicant and respondent no.2, each, in the Library of High Court Bar Association, Aurangabad.
