Heard learned Counsel for the parties, perused the replies filed by the respective respondents. Though
this Court cannot countenance the negligence on the part of the earlier Education Officer Mr.Sukhdeo Sanap in not acting upon the directions issued by this Court as contained in order dated 22nd August, 2013 in Writ Petition No.1443 of 2008, he has filed an affidavit tendering unconditional apology and giving undertaking that henceforth as and when he will receive order passed by the competent court, he will adhere to the orders passed by the Court and comply the same.
So far as Mr.Shashikant Bhaurao Hingonekar, Education Officer (Primary), Zilla Parishad, Beed is concerned, he has also with folded hands, tendered unconditional apology and acted promptly in pursuance to the directions issued on 23rd November, 2015 and placed on record the inquiry report. He has also given an undertaking by filing affidavit-in-reply that as and when he will receive Court orders or directions, he will promptly comply with the same within the stipulated period. In addition to it, even the learned Counsel appearing for the Education Officer has tendered across the Bar an undertaking tendering unconditional apology and also further assurance that, as and when they will receive court orders / directions from the competent court, they will comply it promptly. The said undertaking is taken on record.
In that view of the matter, both the contempt petitions stand dropped. Notices stand discharged.
Needless to observe that the respondents No.2 and 3 in the contempt petitions will show all the promptness and on the basis of the report dated 18th December, 2015 submitted by Mr. Shashikant Bhaurao Hingonekar, Education Officer (Primary), will take prompt steps so as to extend all benefits to the petitioners in Contempt Petition No.175/2014, as expeditiously as possible; however, within ten weeks from today.
It is needless to observe that, in case respondents No.2 and 3 are not adhering to the aforementioned time limit in giving the benefits which are accrued in favour of the petitioners, respondent No.1 shall supervise the said aspect and take appropriate steps. Both the contempt petitions stand disposed of. Parties to act upon authenticated copy of this order.
