At the outset, learned counsel appearing for Respondent No.1 raises objection about filing of successive Petitions and the conduct of the petitioner, and submits that even for the

academic year 2017-2018, the present petitioner filed Writ Petition No.161 of 2017 (Kendriya Residential Schedule Tribe Higher Primary and Secondary Ashram School V/s The State of Maharashtra and others) and the same was disposed of by the Division Bench of this Court (Coram :

V.M. Kanade & Sangitrao S. Patil, JJ) on 24th January, 2017. In last one year, the petitioner did not bother to cure/remove the deficiencies in the proposal submitted by the petitioner.

In response to the submissions made by learned counsel appearing for Respondent No.1, learned counsel appearing for the petitioner submits that the petitioner will remove/cure the deficiencies in the proposal within four weeks from today.

In the light of submissions made across the Bar, the following order is passed :-

ORDER

(i) We direct that the petitioner shall pay late fees within a period of three days and upon payment of late fees, the

petitioners' students shall be permitted to appear for the examinations to be held in the month of March, 2019. The petitioners' students studying in the 10th standard are permitted to appear through other recognized schools as far as possible. The concerned Education Officer shall grant permission to the petitioners' students accordingly within a period of three days.

With the above observations, the Writ Petitions stand disposed of. No costs.

The parties shall act upon authenticated copy of this order.
