Heard Mr. Muthal, learned Advocate for the Applicant and Mr. Wagh, learned Advocate for the Respondent.

This application is filed by wife praying for transfer of the proceeding of Hindu Marriage Petition No.A-168 of 2023 from the Court of learned Judge, Family Court, Aurangabad, District Aurangabad to the Court of learned Judge, Family Court at Nashik. 3.

It is stated that by the applicant-wife that there is no one to accompany her to travel to attend the Court at Aurangabad. The distance between two places is about 183 kms. 4.

The application is vehemently opposed by the learned Advocate for respondent-husband submitting that, the wife has taken false ground in the application. The husband is ready to bear the travelling expenses.

The applicant is the wife. She must be required to attend the Court. However, considering the difficulties faces by the applicant-wife in travelling from Nashik to Aurangabad, this Court is inclined to allow the application. Hence following order :

ORDER

(i) The application is allowed in terms of prayer clause "B".

(ii) After transfer of proceedings, the applicant-wife shall not seek unnecessary adjournments.

(iii) If the Court finds that, unnecessary adjournments are sought by the applicant-wife, the Court may pass appropriate order compensating the respondent-husband when he personally remains present.

(iv) Whenever possible, the respondent-husband may appear through Video Conferencing.
